FSBO escrow is the neutral, third-party process that holds funds and documents when a home is sold without a real estate agent representing either side. Because no agent is coordinating deadlines or paperwork between buyer and seller, a licensed escrow company becomes the transaction’s main safeguard for handling money, instructions, and closing correctly. Sky Escrow provides FSBO escrow services for buyers and sellers throughout Los Angeles County.
Why Does a FSBO Sale Need Escrow Without an Agent?
Escrow is required in a California real estate sale whether or not either side has an agent โ it isn’t something an agent arranges on the buyer’s or seller’s behalf. What changes in a FSBO sale is how much of the informal coordination escrow ends up doing.
In an agent-represented deal, the listing agent and buyer’s agent often handle a layer of day-to-day logistics alongside escrow: reminding a buyer that an inspection deadline is close, confirming a signature came back, flagging a missing disclosure. In a FSBO sale that informal layer doesn’t exist โ escrow is the only neutral party tracking the timeline, holding the earnest money deposit, and confirming documents move between buyer and seller in the right order. In practice, FSBO files often need a more explicit, more frequently repeated timeline from escrow, simply because no one else is reminding either side what’s due next.
Escrow is also not a substitute for an agent: it doesn’t negotiate price or terms, doesn’t advise either party on whether to waive a contingency, and doesn’t represent either side’s interests. Those decisions stay with the buyer and seller, with a real estate attorney if legal questions come up.
How Does the FSBO Escrow Process Work?
Once a buyer and seller have a signed purchase agreement, the FSBO escrow process runs through mostly the same steps as any other California closing โ the difference is who’s driving each step.
| Task | Agent-Represented Sale | FSBO Sale |
|---|---|---|
| Delivering the signed purchase agreement to escrow | Agent submits it | Buyer or seller submits it directly |
| Tracking contingency deadlines | Agent and escrow both track it | Escrow’s timeline is the main reference |
| Requesting missing signatures/documents | Agent often follows up first | Escrow follows up directly |
| Preparing escrow instructions | Drafted from agent-negotiated terms | Drafted from the parties’ direct agreement |
SeeWhat Are Escrow Instructionsfor how those instructions get built from the purchase contract โ in a FSBO sale it’s the buyer and seller, not an agent, who need to submit complete and consistent contract terms before escrow drafts instructions around them.
Once escrow opens, the sequence typically looks like this:
- Buyer and seller submit the signed purchase agreement and open escrow directly with Sky Escrow โ seeHow to Open Escrow.
- The earnest money deposit is delivered to escrow and held in trust.
- Escrow orders a preliminary title report and prepares escrow instructions reflecting the contract terms.
- Required seller disclosures are delivered to the buyer (see below).
- Contingency periods run โ inspection, appraisal, loan approval if the buyer is financing.
- Closing documents are signed, funds are verified, the deed records, and escrow disburses proceeds.
What Disclosures Must a FSBO Seller Still Provide?
Yes โ California disclosure obligations apply to the seller, not to whether an agent is involved, so a FSBO seller still has to provide the same categories of written disclosure a represented seller would. Skipping them because there’s no agent to prepare the paperwork is a real source of post-closing liability for FSBO sellers.
These commonly include a Transfer Disclosure Statement (TDS) covering the condition and known defects of the property, required under California Civil Code section 1102 and following, a Natural Hazard Disclosure (NHD) Statement covering flood, fire, and seismic zones, and โ for homes built before 1978 โ a federal lead-based paint disclosure. California Civil Code section 1102.2 exempts only a narrow set of transfers from the TDS requirement โ foreclosure and trustee’s sales, court-ordered transfers, transfers between co-owners or to a spouse or direct relative, and certain probate transfers โ and being a FSBO sale is not among them, so a FSBO seller has exactly the same disclosure obligations as a represented seller. In an agent-represented sale the listing agent usually supplies these forms as routine; in a FSBO sale that falls entirely on the seller. Escrow can confirm the applicable disclosures were delivered to the buyer as part of closing the file, but does not prepare, interpret, or advise on their content โ a seller with questions about which disclosures apply should confirm with a real estate attorneyCalifornia seller disclosure requirements.
FSBO Escrow in Los Angeles County
Escrow companies operating in Los Angeles County are licensed and regulated by the CaliforniaDFPI, which oversees how escrow companies handle client trust funds under the California Escrow Law. Sky Escrow is licensed by the California DFPI. That requirement applies the same way to a FSBO closing as to any agent-represented sale โ a seller can’t substitute a friend or an unlicensed party for a licensed escrow holder.
Deeds still record with the Los Angeles County Registrar-Recorder/County Clerk, and documentary transfer tax still applies at the county rate plus any applicable city-level rate โ none of that changes because there’s no agent involved. FSBO sellers in Los Angeles sometimes bring in a real estate attorney or transaction coordinator to help with paperwork they’d otherwise rely on an agent for; escrow works the same way regardless.
How Sky Escrow Supports FSBO Transactions
Sky Escrow works directly with FSBO buyers and sellers throughout the greater Los Angeles area, including Malibu, Laguna Beach, and San Diego. That support includes:
- Opening escrow directly from a buyer- and seller-signed purchase agreement, without requiring an agent to submit it
- Holding the earnest money deposit in trust and disbursing it only according to signed instructions
- Ordering the preliminary title report and coordinating with title on any exceptions
- Providing a clear closing timeline and contingency deadlines directly to both parties
- Confirming required disclosures have been delivered before closing
- Coordinating with the buyer’s lender if the purchase is financed

Frequently Asked Questions
Can I use an escrow company if I’m selling my home FSBO?
Yes. Escrow is a required, neutral step in a California closing whether or not either side has an agent, and a buyer or seller can open escrow directly with a licensed escrow company like Sky Escrow.
Do I still need to provide seller disclosures if I’m selling FSBO?
Yes. California’s disclosure requirements apply to the seller, not to whether an agent is involved, so a FSBO seller still has to provide the same required disclosures a represented seller would โ principally the Transfer Disclosure Statement under Civil Code section 1102 and following, and the Natural Hazard Disclosure Statement. There is no FSBO-specific exemption; the only exemptions from the TDS requirement are narrow ones under Civil Code section 1102.2 (foreclosures, court-ordered transfers, transfers between co-owners or close relatives, and certain probate transfers).
Will escrow negotiate with the buyer or seller on my behalf since I don’t have an agent?
No. Escrow is a neutral party that holds funds and documents according to signed instructions โ it does not negotiate terms, advise on price, or represent either party’s interests.
How do I get escrow instructions if there’s no agent to prepare them?
Escrow instructions are drafted from the signed purchase agreement. In a FSBO sale, the buyer or seller (or their attorney) submits that signed agreement directly to escrow, which then prepares instructions reflecting its terms.
Is FSBO escrow more expensive because there’s no agent involved?
Not inherently. Escrow fees are generally based on the transaction itself rather than on whether an agent is present, though FSBO buyers and sellers should confirm fee details directly with escrow since there’s no agent’s estimate to compare against.
